1. The agreement
These terms are between you and Talkthrough. If you use Talkthrough for an organization, you agree on its behalf and confirm you're allowed to. "Customer" means the organization or coach that holds the workspace. "Users" means the people the customer invites, including learners and clients.
2. The service
Talkthrough lets customers build practice scenarios from their own methods, assign them, and review how people do. We're improving it all the time, so features change. Features marked as a pilot, beta or preview are offered as they are and may change or end.
3. Accounts
- Accounts are by invitation. Sign-in uses a link and code sent to your email, so keep access to that email secure.
- The customer decides who is invited and what role they have, and is responsible for its users following these terms.
- Tell us promptly if you think someone has used your account without permission.
4. Your content
- You own it. Customers own their scenarios, criteria, methodology and notes. Users' practice transcripts belong to the customer whose workspace they're in.
- Our permission to use it is limited to running, securing and supporting the service for you.
- No training. We don't use your content to train AI models, and the AI providers we use don't either.
- Your responsibility: you must have the right to upload what you upload, and the customer must give users any notice and get any consent the law requires before they practice.

5. Acceptable use
Don't use Talkthrough to:
- break the law, or harass, threaten or harm anyone;
- upload content you don't have the right to share, or other people's sensitive information they haven't agreed to share;
- try to get into accounts or data that aren't yours, probe or disrupt the service, or get around its limits;
- copy, resell or reverse-engineer the service, or use it to build a competing product;
- make the AI produce content that breaks the usage policies of our AI providers.
We may suspend access that breaks these rules or puts the service or other people at risk. Where we can, we'll tell you first.
6. AI output
- Practice characters, scores and feedback are generated by AI. They can be wrong, so treat them as a practice aid, not as professional, legal or medical advice.
- Scores and feedback are meant for development. Don't use them as the basis for decisions about hiring, promotion, pay or discipline.
- The AI isn't the coach. The customer's coaches and program owners decide what good looks like and review the results.
7. Fees
Fees, the length of a pilot or subscription, and payment terms are set in the order form or quote you agree with us. Unless that says otherwise, fees are paid in advance and aren't refundable.
8. Confidentiality
Each of us will keep the other's non-public business information confidential and use it only for this agreement, except where the law requires disclosure.
9. Ending the agreement
- You can stop using Talkthrough at any time. Paid terms end as the order form says.
- We can end the agreement if you seriously break these terms and don't fix it within 30 days of our notice, or straight away for serious misuse.
- When the agreement ends, you can ask for an export of your content within 30 days. After that, we delete it, except where the law requires us to keep something.
10. Warranties and disclaimers
We'll provide the service with reasonable skill and care. Apart from that, and as far as the law allows, the service is provided "as is", without other warranties, including fitness for a particular purpose. We don't promise it will be uninterrupted or error-free.
11. Limitation of liability
As far as the law allows, neither of us is liable for indirect or consequential losses, or for lost profits, revenue or data. Each side's total liability under this agreement is limited to the fees the customer paid us in the 12 months before the claim. These limits don't apply to a customer's payment obligations, to breaches of confidentiality, or to anything the law doesn't allow to be limited.
12. Changes to these terms
We may update these terms. We'll change the date at the top, and tell account holders before a significant change takes effect. Continuing to use Talkthrough after that means you accept the new terms.
